OPINION: The Potential of House Bill 4010 to Enhance Transparency in Utility Outages

House Bill 4010, introduced by Delegate Pushkin (D – Kanawha, 054), was in response to a utility outage in November 2023 that left over 1,000 residents of Charleston’s West Side, a community where approximately 13% of the population is Black, without essential gas services. The outage, caused by a significant and sustained water leak, disrupted the natural gas distribution system of Mountaineer Gas, affecting heating, cooking, and hot water services for nearly a week, and in some cases, up to a month.
This incident shed light on the critical need for improved communication between utility companies and the communities they serve. The lack of a consistent policy for service disruption notifications left many residents, particularly in a predominantly Black neighborhood, grappling with cold, frustration, and uncertainty about when their utilities would be restored.
To address these challenges, House Bill 4010 mandates that every state utility company establish an outage communication plan for both planned and unexpected service disruptions. These plans must include methods for prior notice to all affected customers regarding planned service interruptions and provide estimates on the duration of any outage. Each utility is required to submit its communication plan to the Public Service Commission for approval. This ensures that utility companies uphold their responsibility to keep all customers, irrespective of their community, informed during service disruptions. The bill aims to establish a framework that guarantees timely and accurate communication from utilities to their customers, thereby mitigating the impact of such disruptions on West Virginia residents, that will ensure equity in communication for communities that are historically marginalized.
As House Bill 4010 advances to the Senate Government Organizaton Comitte tomorrow, March 5th, 2024 at 2pm optimism grows regarding its passage, especially among those in areas represented by Senators Marc Hunt (R – Kanawha, 08) and Glen Jeffries (R – Putnam, 08), whose constituencies include the West Side. This bill marks a pivotal step toward enhancing the transparency and responsiveness of utility services in West Virginia. This legislative initiative is a testament to a commitment to safeguarding all residents against the challenges posed by utility service disruptions, promising a future where every resident, especially those in historically marginalized communities, is kept informed and prepared.
